Terms of Service

1. Acceptance

By creating a TalkGen account or using the TalkGen API, web app, or any related service (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

TalkGen provides text-to-speech generation, voice cloning, and related audio tooling. We may add, change, or remove features at any time. Service availability is offered on a commercially reasonable basis and is not guaranteed to be uninterrupted.

3. Accounts and security

You are responsible for safeguarding your account credentials and API keys, and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Acceptable use

You agree not to use the Service to:

  • impersonate any person without their explicit, verifiable consent;
  • generate audio that is illegal, defamatory, harassing, or that violates third-party rights;
  • create CSAM, non-consensual intimate content, or content depicting real people in sexual contexts;
  • produce political deepfakes intended to deceive voters or to disrupt democratic processes;
  • circumvent rate limits, quotas, billing, or any technical safeguards;
  • resell or sublicense the Service except as expressly permitted by your plan.

5. Voice cloning

Cloning a voice that is not your own requires the documented, informed consent of that person. By uploading a voice sample, you represent and warrant that you have obtained that consent. See the Voice Cloning Consent Policy for details.

6. Content ownership and license

You retain ownership of the text you submit and the audio TalkGen generates from it, subject to your compliance with these Terms. You grant TalkGen a limited license to process, store, and transmit your content as necessary to operate the Service. We do not train models on your content without an opt-in.

7. Plans, payment, and refunds

Paid plans are billed in advance on a monthly basis. Charges are non-refundable except where required by law. We may change pricing on 30 days’ notice; changes apply to the next billing period.

8. Termination

We may suspend or terminate your access for any breach of these Terms, including suspected abuse, fraud, or violation of the Acceptable Use rules above. You may close your account at any time from your dashboard.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKGEN’S AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Changes

We may update these Terms from time to time. Material changes will be announced by email or in-app at least 14 days before they take effect.
